Terms of Service
These terms are the agreement between you and the operator of Render Studio. By creating an account you accept them. Please read them together with the Privacy Policy.
1. Who provides the service
Render Studio ("the service") is provided by [[LEGAL_ENTITY]], [[POSTAL_ADDRESS]] ("we", "us"). Company and tax registration: [[COMPANY_NUMBER_VAT]]. You can reach us at [[SUPPORT_EMAIL]] or through the contact page.
The service is a set of online tools that turn architectural drawings, model views and photographs into rendered images with the help of an artificial-intelligence image model. It is made for professional use by architects, designers and people working with them.
You must be at least [[MIN_AGE]] years old to use the service. If you use it for a company or a practice, you confirm that you are allowed to accept these terms for it.
2. Your account
- You need an account with an email address that you own and can receive mail at. We send a confirmation link to it; some features, including free credits, are only available after you have confirmed the address.
- One account per person. Do not create several accounts, or use several addresses that lead to the same mailbox, to collect free credits more than once.
- Keep your password to yourself. You are responsible for what is done through your account. Tell us at once if you think someone else has used it.
- We may suspend or close an account that breaks these terms, that is used to abuse the service or its limits, or that puts the service or other users at risk. Where it is reasonable we will tell you why and give you the chance to respond.
3. Credits
- What a credit is. Credits are the unit used to pay for images on the service. Every image you generate uses one or more credits. The number depends on the resolution you choose; it is shown on the Generate button before you confirm and on your Account page. Each variation is a separate image and is charged separately.
- Free credits. A new account may receive free credits once its email address has been confirmed. They are given once per person. We may refuse or withdraw them where the same person or mailbox has received them before, including through an account that has since been deleted.
- No online purchase. Credits cannot be bought on the website. Additional credits are arranged directly with us (see the contact page) and are added to your account by us. Price and payment are agreed with you before any credits are added.
- Failed images. If an image cannot be generated, the credits taken for it are returned to your account automatically. This normally happens straight away and in rare cases within about an hour. If an image is generated but cannot be saved to your History, you still receive it on screen and the credits are returned.
- No cash value. Credits are not money. They cannot be exchanged for cash, transferred to another account or sold on, and they carry no interest.
- Refunds. [[CREDIT_REFUND_POLICY]]
- Expiry. [[CREDIT_EXPIRY]]
- Closing your account. When you delete your account, any credits left on it are removed with it. If you have paid for credits you have not used, contact us before you delete the account.
4. What you upload
- You keep all rights you have in the drawings, models, photographs, reference images and text you upload ("your content"), and in the images produced from them to the extent the law grants such rights.
- You confirm that you are allowed to upload your content and to have it processed as described here. This matters in particular for client drawings, for photographs showing identifiable people or private property, and for reference images made by someone else.
- You give us permission to use your content only as far as needed to run the service for you: to send it to the image model, to create the result, to store the result, your prompt and your settings in your private History, and to show them to you. We do not publish your content, and we do not use it to advertise the service.
- Your content is processed by a third-party provider, Google, as described in the Privacy Policy. Do not upload material that you are not permitted to share with such a provider, for example under a confidentiality agreement with a client.
5. Images made by artificial intelligence
Results are generated by an artificial-intelligence model operated by a third party. Please keep the following in mind every time you use one.
- They can be wrong. A result may change geometry, proportions, dimensions, materials, the number of storeys or openings, or the surroundings, even when you asked for the geometry to be kept. It may add things that do not exist and leave out things that do.
- They are illustrations, not documents. Results are visual impressions. They are not construction documents, surveys or technical drawings, and must not be relied on for structural, dimensional, planning, regulatory, cost or safety decisions.
- You must check them. You are responsible for reviewing every result before you show it to a client, publish it or base a decision on it, and for making clear to others, where it matters, that an image was generated by artificial intelligence.
- They may not be unique. The same or a similar input can produce similar results for other users.
- No promise about rights. We do not promise that a result can be protected by copyright or other rights, or that it is free of rights held by others. The law on images made by artificial intelligence differs between countries and is still changing.
- Requests can be refused. The model provider applies its own safety filters. A request can be blocked or return no image. In that case the credits are returned as described in section 3.
6. Acceptable use
You agree not to use the service to:
- create, upload or share content that is unlawful, that infringes the rights of others, or that is sexually explicit, hateful, harassing or violent;
- produce images of real, identifiable people in a way that is misleading, degrading or abusive, or that they have not agreed to;
- present generated images as photographs of real, existing buildings or places in order to deceive, for example in a sale, a planning application or an insurance claim;
- get around hourly or daily limits, credit charges, account restrictions or security measures, or use more than one account to do so;
- access the service with scripts, bots or other automated means, copy its prompts or outputs in bulk, or resell access to it, unless we have agreed to this in writing;
- probe, overload or disrupt the service or the systems it runs on.
The usage policies of the model provider apply as well; they are linked in the Privacy Policy.
7. Availability, limits and storage
- We work to keep the service running, but we do not promise that it is available at all times or free of errors. It depends on third parties, in particular the model provider and our hosting provider, and may be interrupted for maintenance or for reasons outside our control.
- To keep costs and abuse under control there are limits on how many images one account, one network and the service as a whole can generate per hour and per day, on how many can be in progress at the same moment, and on how many failed requests one account can make per hour. When a limit is reached, further requests are refused until it resets or the images in progress have finished; nothing is charged for a refused request.
- Results are kept for 30 days. Each generated image is stored in your private History for that period, counted from the moment it was made, and is then deleted automatically and cannot be restored. Download what you want to keep. You can delete any image earlier yourself.
- We may change, add or remove tools and features. If a change materially reduces what you can do with credits you have paid for, section 3 (Refunds) applies.
8. Our responsibility to you
- The service is provided "as is". To the extent the law allows, we give no warranty that results are accurate, complete, fit for a particular purpose or free of third-party rights.
- To the extent the law allows, we are not liable for indirect or consequential loss, for loss of profit, business or data, or for decisions taken on the basis of a generated image, and our total liability to you in any twelve-month period is limited to the amount you paid us for credits in that period.
- Nothing in these terms limits liability that cannot be limited by law, such as liability for death or personal injury caused by negligence, for fraud, or for intent and gross negligence. If you use the service as a consumer, your statutory rights are not affected.
- You are responsible for your content and for how you use the results. If a third party makes a claim against us because of your content or your use of the service in breach of these terms, you will compensate us for the reasonable costs that result.
9. Ending the agreement
- You can stop using the service at any time and delete your account on the Account page. Deletion takes effect immediately; what is removed and what is kept is described in the Privacy Policy.
- We can end the agreement and close your account if you seriously or repeatedly break these terms, or if we stop offering the service. If we stop offering the service, we will give reasonable notice where we can, so that you can download your images.
10. Changes to these terms
We may update these terms, for example when the service or the law changes. The version and the date at the top of this page show which text is in force. If a change is significant we will tell you by email or on the site before it takes effect. If you do not agree with a change, you can delete your account; continuing to use the service after the change takes effect means you accept it.
11. Governing law and disputes
These terms are governed by the law of [[JURISDICTION]], and the courts of [[JURISDICTION]] are responsible for disputes arising from them. If you use the service as a consumer, mandatory consumer-protection rules of the country you live in continue to apply, and you may also bring proceedings there.
If one provision of these terms turns out to be invalid, the rest stays in force.
